I have the same questions regarding her DMCA claims and the timing of her application. It’s not final and will not be final for some time. An examiner is not even appointed yet to her application and from my understanding of the process, they won’t appoint one for approx. 3 months. Before you get a copyright/trademark, they do investigate to ensure you are not attempting to claim something that is not yours and not in conflict with any other copyrights/trademarks.

#44 is really just stupid! Waaaaaaaay back in the early SL beginning there were FREE templates given (by LL) out so that people could create content. Chip Midnight took the free content and elevated it. And gave it out free. C BUT, all of the templates for SL heads and how clothing lays on a body can be traced back to the original templates. Which is what the AK mesh head designer did. Even Catwa’s side by side shows they are from the base templates from the first.

I hate to break it to you but terms of service doesn’t mean it’s legal by any means it is however a way to deter frivolous lawsuits. Not every tos you agree too will be upheld in arbitration. As for catwa she has every right to defend her brand but she does not have the right to bully or push smaller brands around and claim copyright infringement over a license she never owned to begin with. She opened herself up to a slew of legal trouble once she filed a false dmca and publicly bashed other creators before she got her trademark. Its surprising to me all of these larger brands in second life have no trademark or any sort of protection to their assets in real life.
There is a difference between a registered trademark and an unregistered one. Both have protections in their own right but a registered one has more. The major thing that has to be proven in court to protect your trademark is its use by you. That’s why you don’t see hoards of people making logos and claiming trademark when they don’t use the logos for anything.
